I did a remix for Spectrasonics (Omni competition) and they made it very clear the samples could be used for commercial purposes and made no restriction that I could see. I guess (just to add to other posts of caution on the matter already here) it is always best to carefully read any small print.

This can vary alot between remix comps, so you need to read the small print of the remix comp sample usage and remix usage agreement carefully.

Sometimes even when its a case of fair splits etc (quite rare), there may be a date limit on public release of any remix (for eg to keep your remix off the net until until original and winning mixes are available etc).

'Sampling' is one of those 'grey' areas.

Legally, there is little (if any real) perceived value to sample based music. This puts all of the control of use with the original owner.
There are a couple of points that you can contend and argue upon. First one is called 'Fair Use', which states that copyright may be breached for purposes of parody,comparision, education and review. I don't think it's ever been tested in the UK, but there was a massive, massive argument many years ago involving Roy Orbison's publishers suing a Hip-hop group who did a pisstake of 'Pretty Woman'. The hip-hoppers actually won. Although it wasn't enough to set a legal precedent for what is fair use. It's still viewed on a case by case basis, and therefore isn't a reliable 'excuse' for sampling.
The other point is that there is a weird point in copyright, that states if sufficient skill and technique has gone into producing the sample, it can then take on a right to be original itself. Ie if you sample something, reverse it, pitch it and loop it...you may get away with it. But if you get caught by a 'sample troll' like bridgeport inc...you are well and truly knackered !

Bridgeport are a nasty bunch. They are rumoured to have faked documents to acquire the copyrights to the song, then used these rights to sue Jay-Z.

Thanks for the link Ed. I just read the article. Bridgeports approach while lucrative is pretty messed up. I am not sure how a company like that can survive for so long. It's one thing to sue for someone elses work but then keep the cash and not pass that on to the Artist originally responsible for the work

It's baffling how Bridgeport avoid being sued themselves.

I've just found somet else out actually.

Eric Prydz Panjoo..... I'm 99% sure he lifted the string line from this



and used it 'double time' as the bass.



Just to clarify what he's done, I've replayed the part from the clip, then done it as his bass to demonstrate. They were both played on RP predator so that you hear how similar they are. The original version is played up first, with my version of his bass following.. same notes, different octave and played 2x tempo. That's all he did to it

now, take it down a couple of octaves, and play it double time.

right the bass line was so much easier to follow for me, it's simply the root note of the strings chords, lol and yeah the prydz is how you said it but for some reason i was hearing

I played it your way, but I think my original description was right. Or I hear it that way.

That said, your take on it fits well as well... it could be either.

The fact remains though..his bassline is either identical or only just adjusted...

no i fully agree with you, i just hear his bass line exactly how you describe it but the strings just where not sitting quite the same i think it could of been my way then your way so its both in the loop and the strings are out of tune to my ear but then i don't know what the hell is going on half the time but yes missing the point here. they are extremely similar or identical note wise, makes you wonder
